do i need to pay a parking ticket if there were no signs posted anywhere?

a ticket was issued for parking on the grass. the grass patch is worn away from other cars parking there. the grass in question runs along side a closed traffic right of way within a boat marina in the city of buffalo.within the marina there are no signs posted not to park in certain areas.

  1. In most places, it's illegal to park offroad. As such, signs stating that are unnecessary. Learn the local laws before you start driving.
  2. Is it private property or public? Private property you might be able to get away with it. Public you can only park in clearly marked spots. If the fine is not too much I would pay it and mark it in the "they got me book".
  3. Usually an unwritten law is do not park on the grass. Since no signs were posted, it could be a point of contention as to where would one park at a marina when all the parking slot are in use with cars, trucks and trailers?
  4. You have been accused. If you are trying to ask if someone in parking enforcement will know of your defense and automatically dismiss the accusation without requiring you to defend, the answer is no. If you want to know if your question presents a potential defense or is a confession, I suggest you first read the ordinance listed on the ticket. Not the title, the whole ordinance. You can probably find it at the public library or certainly at a law library at the courthouse.
  5. Generally, whenever you are entering an enclosed locale or area designated by boundary, there are signs that have to be posted at the main entrance; Private Property, Time Limit, Permit Parking, Designated/Restricted Parking. Review the sign(s) at the entrance. (Just a curiosity. You're sure it's not for still being partially on the roadway?)
